Booking and Confirmation
Clients must confirm their booking in writing and provide all necessary details regarding the car or event shoot, including date, time, location, and any special requests. A non-refundable deposit may be required to secure the booking.
Cancellation and Rescheduling
In the event of cancellation or rescheduling, clients must provide written notice to N3rd Media at least 30 days before the scheduled shoot. Failure to do so will result in forfeiture of the deposit and/or additional fees.
Payment Terms
Full payment for services is due upfront. This is required to reserve our time and allow us to turn away other customers.
Copyright and Usage Rights
N3rd Media retains copyright to all images taken during the car or event shoot. Clients are granted a non-exclusive, non-transferable license to use the images for personal, or commercial purposes.
Image Delivery
N3rd Media will deliver a predetermined number of edited, high-resolution images within [number of days] days of the shoot. Images will be provided in digital format, with the option for clients to purchase additional prints or products.
Image Editing and Retouching
Basic editing and retouching are included in the photography package. Additional or extensive retouching requests may be subject to additional fees.
Liability and Indemnification
N3rd Media is not responsible for any injuries or damages sustained during the car or event shoot. Clients are responsible for their own safety and the safety of their property. Clients agree to indemnify and hold harmless N3rd Media from any claims, damages, or expenses arising from the shoot, including any third-party claims.
Weather and Unforeseen Circumstances
In the event of inclement weather or other unforeseen circumstances that prevent the shoot from taking place as planned, N3rd Media and client will work together to reschedule the shoot at the earliest possible date. N3rd Media is not liable for any costs or losses incurred by the client due to these circumstances.
Location and Permits
The client is responsible for securing any necessary permits or permissions required for the shoot location. N3rd Media is not responsible for any fines, fees, or penalties resulting from failure to obtain proper permits or permissions.
Cooperation and Conduct
Clients are expected to cooperate with N3rd Media’s direction and maintain a respectful and professional demeanor during the shoot. N3rd Media reserves the right to terminate the session without refund if the client’s conduct is deemed inappropriate or uncooperative.
Model Release
By participating in the shoot, clients grant N3rd Media permission to use their likeness in promotional materials, social media, and other marketing efforts. Clients may request that their images not be used for these purposes in writing before the shoot.
Additional Services and Products
Additional services or products, such as extra prints, albums, or extended photo sessions, may be available for an additional fee. Clients should discuss any special requests or needs with N3rd Media prior to the shoot.
Governing Law
These terms and conditions shall be governed by the laws of California and any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts in California
Changes to Terms and Conditions
N3rd Media reserves the right to amend these terms and conditions at any time, provided that clients are notified in writing of any significant changes that may affect their agreement.
Entire Agreement
These terms and conditions, together with any booking confirmation, represent the entire agreement between N3rd Media and the client. No verbal agreements or understandings shall supersede or modify the terms of this agreement.
